Section 5 - Continental Use 5.1 European Union Compulsory Insurance In compliance with European Union (EU) directives the insurance provided by this policy will allow the minimum cover required to use Your Motorcycle in: - Any country which is a member of the European Union - Any country which the Commission of the EU is satisfied has made arrangements to meet the requirements of Article 7.2 of the EU directive of Civil Liabilities arising from the use of Motor Vehicles. 1 5.2 Foreign Use In addition to this minimum cover the insurance provides the cover shown in the Schedule in any country in the Territorial Limits, subject to Your usual place of residence being in Great Britain, Northern Ireland, the Channel Islands and the Isle of Man. This extension is provided for the purpose of travel only. Cover under this section includes: - Transit by sea or rail in or between countries within the territorial limits. - Reimbursement of any customs duty You may have to pay after temporarily importing your motorcycle into any country within the territorial limits subject to Your liability arising as a direct result of a claim covered under this policy. - If as a result of an accident in Spain which is, or might be, the subject of a claim under this policy, You or any person riding with Your permission are detained or Your Motorcycle impounded by the competent authorities and a guarantee or monetary deposit is required for their release, We will provide such guarantee or deposit not exceeding £5,000 in all. Immediately the guarantee is released or the deposit becomes recoverable, You must give Us all necessary assistance to obtain cancellation of the guarantee or return of the deposit. If all or part of the guarantee or deposit is lost or taken to pay fines or costs, You must pay Us the lost amount immediately. If you need to report a claim calling from outside the UK please contact our European Claims First Response team on 00 44 1454 636964 5.3 International Motor Insurance Card (Green Card) All countries mentioned in 5.1 have agreed that a Green Card is no longer necessary for cross border travel. Your policy, Schedule and Certificate of Motor Insurance will therefore provide sufficient evidence that you are complying with the laws relating to compulsory motor insurance in any of these countries that you visit. Part B - Your Breakdown Assistance Policy Introduction Welcome to Your Breakdown Assistance Policy. In order to make sure You get the most from Your cover, please take time to read the policy. It explains the contract between You and Us. If You have any questions or would like more information, please contact eBike Insurance Definition of terms Throughout this Policy the following words and phrases have the meaning set out below wherever they appear: We/Us/Our Southern Rock Insurance Company Limited You/Your The person who has taken out this policy Insured Person(s) You, and any passenger or driver who is in the Vehicle with Your permission at the time of the Breakdown. Vehicle The Vehicle(s) listed on Your Certificate of Insurance. The vehicle must be a mechanically propelled two wheeled Vehicle with or without a sidecar or trailer attached. Any trailer attached to the Vehicle must not exceed 7.6 metres in length. Territorial Limit The United Kingdom of Great Britain and Northern Ireland, the Isle of Man and the Channel Islands. Breakdown (a) Mechanical or electrical failure; or (b) Accidental damage, or damage caused by vandalism, Fire, Theft or attempted Theft, which renders Your vehicle immobile. Period of Cover The period shown in Your Schedule and for which You have paid the premium Cover Provided You are covered for the assistance services in this policy for a maximum of six breakdowns during the period of insurance if you have paid the appropriate premium. We agree to provide the assistance services in this policy keeping to the terms, conditions and exclusions as long as the breakdown happens during the period of insurance and within the territorial limits. After We have dealt with your sixth Breakdown, this policy becomes void. Assistance Services Under This Policy 1. Emergency Roadside Repairs and Home Breakdown We will pay the call-out charge and up to one hours labour costs for one of Our approved agents to attend the scene of the Breakdown and where possible carry out emergency repairs. 2. Vehicle Recovery If Your Vehicle cannot be repaired at the scene of the Breakdown within one hour, We will pay for the cost of transporting Your Vehicle and Insured Person(s) to a single destination, being either; (a) A suitable repairer; or (b) If the Insured Person wishes, their home address provided it is nearer. 3. Getting You to Your Destination If Your Vehicle cannot be repaired on the same day as the Breakdown, We will either: (a) Pay the cost of transporting Your Vehicle or Insured Person(s) or both to a destination within the Territorial Limit provided that the Insured Person(s) are transported to the same destination; or (b) Arrange transport for Insured Person(s) to travel to a hotel. You will have to pay for the cost of this, and the hotel costs; but We will reimburse You up to £50 per person per night for accommodation. The most We will pay for transport to the hotel and the cost of hotel accommodation is £300 for any one Breakdown. You must pay the hotel bill, but We will pay You back on receipt of the relevant bill(s) subject to the £300 limit for any one Breakdown. Conditions (i) We will only pay a maximum of £300 for any one Breakdown. (ii) You must send Us all the relevant invoice(s) before We will reimburse You. At all times We decide on the best way of providing help. 4. Emergency Message Service When You claim for any one of the services detailed in 1, 2 and 3 above We will forward a message to a member of Your family, friend or work colleague if You would like this. General Exclusions 1. The Breakdown of Your Vehicle: - within the first 48 hours from the date of Your application if cover commences at any time other than at inception or renewal of the insurance policy to which this cover is attached; or - if it has knowingly been driven in an unsafe or unroadworthy condition; or - which has resulted from the lack of oil, fuel or water; or - which occurs whilst Your vehicle is being used for motor racing, trials or rallying. 2. The cost of: - spare or replacement parts, fluids or fuel or any other materials used in repairing Your Vehicle; or - any other repairs carried out other than those carried out at the scene of the Breakdown; or - replacing a wheel if Your vehicle does not have a serviceable spare wheel; or - replacing broken windows or keys or finding missing keys; or - ferry crossings, parking charges, fines or toll charges - storage charges, You will be responsible for any Vehicle storage charges incurred when You are using Our services 3. Any charges arising from an Insured Persons failure to comply with Our instructions or Our approved agents instructions in respect of the assistance being provided. 4. Any costs incurred before You have notified Us of the Breakdown. 5. The recovery of a trailer or caravan on tow which exceeds 7.6 metres (25 feet) in length. 6. Any Vehicle which cannot be recovered by a standard trailer or transporter. 7. Breakdowns caused by, contributed to, or arising from: - Ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from burning nuclear fuel; or - The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear part of it; or - War, invasion, foreign enemy hostilities (whether war is declared or not), civil war, rebellion, revolution, military force or coup; or - Pressure waves caused by aircraft or other airborne devices travelling at sonic or supersonic speeds. General Conditions 1. An Insured Person must keep to the terms and conditions of this policy. 2. The Vehicle shall at all times during the Period of Insurance be maintained in a roadworthy condition and regularly serviced. 3. We can cancel Your Policy at any time by sending You not less than 7 days notice by recorded delivery to Your last known address. We will reimburse You on a pro rata basis the premium for the Period of Insurance still remaining. We will always cancel Your Policy after We have dealt with Your sixth claim in the Period of Insurance. If Your Policy is cancelled because We have covered You for six Breakdowns in the Period of Cover, We will not refund any premium You have paid. You have the right to cancel Your Policy during a period of 14 days either from the day of purchase of the policy or the day on which You receive Your Policy documentation, whichever is later. If You have not made a claim within the first 14 days and decide to cancel we will refund the premium You have paid subject to a deduction for the time You have been covered and for any cost incurred by Us in issuing the policy. If you make a claim within the first 14 days and decide to cancel, you will not be eligible for any refund. If You cancel Your Policy after 14 days, no refund will be applied. 4. An Insured Person must be present with the Vehicle when the approved agent arrives. 5. We will make every effort to provide the service at all times, but We will not be responsible for any liability arising from breakdown of the service. 6. We will not be responsible for any consequential loss in connection with a Breakdown no matter how it is caused. 7. The transportation of any animal or livestock is undertaken solely at Our discretion and We accept no liability for the safety or welfare of any animal or livestock during its transportation. 8. This policy is governed by English law. 9. We will not pay any claim covered under any other policy, or any claim that would have been covered by any other policy if this policy did not exist. How to Claim We are here to help You 24 hours a day, 365 days a year. In the event of a Breakdown, call our Freephone Motor Assistance helpline on 0808 168 0750 and provide the following information: - Policyholders name - Registration number of the Vehicle. - Make, model and colour of the Vehicle. - Nature of the Breakdown and location of the Vehicle. An operator will arrange for one of Our approved agents to come to Your assistance as quickly as possible. It is important to contact Our helpline as soon as possible after the Breakdown. We will not cover any call out charges and labour costs unless We have given Our agreement. All telephone calls to Us are monitored and recorded as part of Our training and quality assurance programmes. When We Cannot Help Our approved agents cannot work on Your Vehicle if it is unattended. Please do not arrange assistance before We have agreed, if You do We will not pay the costs involved. How to Complain We will always try to give You a quality service. If You think We have let You down, We have internal complaint handling procedures. A copy of these are available on request. Please address all complaints to Our Managing Director at Head Office, who will direct the complaint to the head of the relevant department(s). European breakdown assistance is available as an extension to your policy for £49.99 and is underwritten by Southern Rock Insurance Company Limited. European breakdown assistance extends your free breakdown assistance policy to the following countries providing your bike is no more than 10 years old: The European Union (excluding the United Kingdom of Great Britain and Northern Ireland, the Isle of Man and the Channel Islands), Albania, Andorra, Bosnia Herzegovina, Bulgaria, Croatia, Gibraltar, Iceland, Liechtenstein, Macedonia, Monaco, Montenegro, Norway, Romania, San Marino, Switzerland and Turkey (west of the Bosphorus). European breakdown assistance provides the following cover in these countries: Emergency Roadside Repairs We will pay the call-out charges and up to one hours labour costs for one of our approved agents to attend the scene of the Breakdown and, where possible, carry out emergency repairs. Bike Recovery If your bike cannot be repaired within one hour at the scene of the Breakdown, we will pay for the cost of transporting your bike to a suitable repairer. Getting You to Your Destination If your bike cannot be repaired on the same day as the breakdown, we will: - pay the cost of transporting your bike or insured person(s) or both to a destination within the territorial limits up to the value of the bike provided that the insured person(s) are transported to the same destination; or - pay the cost of hiring a replacement bike to allow the insured person(s) to continue their journey to a destination within the territorial limits, but the most we will pay for any one claim is £750 and any replacement bike provided on the European mainland must remain within the territorial limits or the United Kingdom of Great Britain and Northern Ireland, the Isle of Man, the Channel Islands and the Republic of Ireland; or - arrange the transport for the insured person(s) to a hotel. You will have to pay for the costs of this, and the hotel costs, but we will reimburse you up to £50 per person per night for accommodation. The most we will pay for transport to the hotel and the cost of accommodation is £500 for any one breakdown. You must pay the hotel bill, but we will pay you back on receipt of the relevant bill(s) subject to the £500 limit for any one breakdown. European breakdown assistance cover is subject to the following conditions: At all times Southern Rock decide on the best way of providing help. The most Southern Rock will pay for all claims arising from any one breakdown is £3,000. You must send Southern Rock all the relevant invoice(s) before we will reimburse you. | |||

Section 1. Loss of or damage to your motorcycle 1.1 Loss of or damage to your motorcycle If Your Motorcycle is lost, stolen or damaged, We will, at our option, either - Pay for Your Motorcycle to be repaired; or - Replace Your Motorcycle; or - Pay in cash the amount of the loss or damage. The same cover also applies to Accessories and spare parts relating to Your Motorcycle while these are on Your Motorcycle. The maximum amount We will pay will be the Market Value of Your Motorcycle but not exceeding your estimate of value shown in our records. If, to our knowledge, Your Motorcycle is subject to a hire purchase or leasing agreement, any payment will be made to the owner described in that agreement whose receipt will be a full and final discharge to Us . If a replacement for any damaged accessory or part of Your Motorcycle is not available We will pay the value of the accessory or part at the time of the loss. We will not pay more than the manufacturers last quoted list price in the United Kingdom for the accessory or part. If such list is not available the most We will pay is the manufacturers last quoted list price in the United Kingdom for an equivalent accessory or part. We may use Accessories or parts, which are not made or supplied by the manufacturer of Your Motorcycle but are of a similar type and quality to the parts we are replacing. We reserve the right to replace any parts with a part that is standard to the manufacture of the Motorcycle. We will not be responsible for additional storage costs caused by the unavailability of an accessory or spare part nor the cost of importation of any accessory or part into the United Kingdom. We will retain at Our discretion, the right to the salvage of a vehicle following a total loss for disposal in accordance with the Association of British Insurers code of practice. | |||

The eBike Hire Bike policy is available as an optional cover at a premium of £39.99 and is underwritten by Ultimate Insurance Solutions Ltd Demands and Needs Statement This product meets the demands and needs of a driver whose motorcycle has been rendered a total loss in a Road Traffic Accident or stolen recovered incident or had their motorcycle stolen and it remains unrecovered and who will be using the replacement motorcycle facility provided by AVR Ltd. This Policy will cover You against the replacement motorcycle hire charges within the terms and conditions of Your eBike Insurance Motorcycle Hire Cover, which are not recoverable from any Third Party. eBike Insurance Motorcycle Hire Policy Policy Summary Acceptance The policy can be purchased as an extension to a single driver, multi vehicle policy and on a multi driver, single vehicle policy. The policy cannot be purchased as an extension on a multi driver, multi vehicle policy. Please further note that the policy will only cover the proposer and the vehicle(s) registered to them that are named on the policy. Motorcycle Hire Cover This Policy summary does not contain full terms and conditions of the cover, which can be found in the Policy document. Significant Features and Benefits: - Covers any motorcycle up to a maximum of 1000cc - Up to 14 days of continuous motorcycle hire - A Hire Motorcycle the same or similar to the Insured Vehicle provided by AVR Ltd, within the Territorial Limits - A Hire Motorcycle for when the Insured Vehicle is rendered a total loss through an Insured Incident - A Hire Motorcycle for when the Insured Vehicle has been stolen and not recovered Significant and Unusual Exclusions or Limitations: - A maximum of two claims can be made within the Period of Insurance. - The Insured Person must have held a Compulsory Bike Test Certificate for more than two months and be licensed to ride the Hire Vehicle. The following are not covered under this Policy: - Any claim reported to eBike Insurance more than five days after the Insured Incident - All fuel, fares, fines and fees relating to the Hire Motorcycle whilst in Your possession - Any claim where the Insured Vehicle was being used for hire or reward - Any claim for theft which has not been reported to the Police Duration The period of the motor insurance policy which runs concurrent with this Policy and does not exceed twelve months. Cancellation You may cancel Your Policy and receive a full refund up to fourteen days after receipt of the Policy, subject to no claim having been made upon the Policy. If You do not exercise this right to cancel Your Policy, it will remain in force for the term of the Policy and You will be required to pay the Premium. If You want to cancel Your Policy after 14 days no refund will be payable. Claim Notification To make a claim please call the Claims Line 0844 800 0199. How to Make a Complaint Complaints should be made to eBike Insurance and if you remain dissatisfied to Ultimate Insurance Solutions Ltd. Financial Services Compensation Scheme This Policy is covered by the Financial Services Compensation Scheme (FSCS). If the Underwriters were unable to meet their obligations, You may be entitled to compensation from the scheme, depending on the type of insurance and circumstances of any claim. The first £2,000 of a claim or policy is protected in full and above this threshold, 90% of the rest of the claim can be met. Further information can be obtained from www.FSCS.org.uk Your Motorcycle Hire Policy This is to confirm that Ultimate Insurance Solutions Ltd on behalf of certain Underwriters at Lloyds will provide the cover described below during the Period of Insurance. Cover is subject to the terms and conditions that follow. Payment of the Motorcycle Hire Premium must be paid before cover is provided. Albany Vehicle Rentals Ltd (AVR Ltd) or a supplier of AVR. Ltd provides the benefits under this Policy, however the contract is between Ultimate Insurance Services Ltd on behalf of certain Underwriters at Lloyds and the Policyholder. Definitions Please find below an explanation of the words used in this insurance Policy: Hire Vehicle A motorcycle the same as the Insured Vehicle and not exceeding 1000cc or, if not available, as similar a model as is possible as determined by AVR Ltd, within the Territorial Limits. Insured Incident A road traffic accident or stolen recovered incident that makes the Insured Vehicle a total loss as decided by the motorcycle insurer if the damage is covered under the current motorcycle insurance policy OR, by the Third Party You are claiming against for your losses OR, if a fault accident by a garage who is a member of the Vehicle Builders & Repairers Association (VBRA) or the Motor Vehicle Repairers Association (MVRA) or another similar recognised body. Alternatively, it is where the Insured Vehicle is stolen and it is not found. Insured Person/You/Your A driving licence holder who has held a Compulsory Bike Test certificate for a minimum of two months and who appears on the current Certificate of Motorcycle Insurance issued through eBike Insurance. Insured Vehicle Any motorcycle up to 1000cc maximum insured through eBike Insurance that appears on a current Certificate of Motorcycle Insurance, and for which a Premium has been paid for Motorcycle Hire cover. Period of Insurance The period of the motorcycle insurance policy which runs concurrent with this Policy and does not exceed 12 months. Policy This Policy of insurance Policyholder The person, firm or company who has taken out this Policy and has paid the Premium due. Premium The payment, which is required to be paid to eBike Insurance, by You for the Insured Person to obtain benefit of this Policy. Provider AVR Ltd Territorial Limits Great Britain, Northern Ireland, Isle of Man and for residents of the Channel Islands. Third Party The other person(s) and/or party(s) responsible for the Insured Incident, excluding the Insured Person and/or Policyholder (as defined in this Policy). Underwriters Ultimate Insurance Solutions Ltd on behalf of certain Underwriters at Lloyds. Each Underwriter is only liable for their share of the risk and not for each others share. You may ask for the names of the Underwriters and the share of the risk each has taken on. Ultimate Insurance Solutions Ltd is a Lloyds Coverholder who have been granted authority to accept insurance and make claims payments on behalf of certain Lloyds syndicates. What is Covered? - This insurance provides for up to 14 days of continuous motorcycle hire within the Territorial Limits following an Insured Incident during the Period of Insurance and within those Territorial Limits. - A maximum of two claims in the Period of Insurance can be made. You may extend the hire by contacting Albany Assistance Ltd on 0191 350 3243 who will then contact AVR Ltd to make arrangements. A discounted rate is available to eBike Insurance customers. The Hire Vehicle must be returned to AVR Ltd or its designated agent no later than 48 hours after payment is issued to the Policyholder based on the motorcycle insurers total loss valuation of their claim OR no later than the 14th day of hire (whichever comes first). How to Claim your Hire Vehicle Following an Insured Incident, You must report it immediately to Your motorcycle insurance company (Helpline telephone number shown on Your Motorcycle Policy) and to the Police if the Insured Vehicle was stolen. Please only call Albany Assistance Ltd on 0844 800 0199 to obtain Your Hire Vehicle. We will advise AVR Ltd, who will contact You to arrange the supply of a Hire Vehicle. You should note that the following conditions apply in all circumstances: a. a security/fuel deposit is payable by You on collection of the Hire Vehicle. This is refundable upon its return provided it is free from damage and has the same amount of fuel as when collected b. when taking possession of the Hire Vehicle, the driver will need to produce their current driving licence, current Compulsory Bike Test Certificate and personal identification, e.g. phone bill c. You must have a valid motorcycle insurance through eBike Insurance to take advantage of this cover d. Hire Vehicles are provided in accordance with AVR Ltd or its agents standard requirements, terms and conditions which all drivers must meet e. a Hire Vehicle will only be provided once Albany Assistance Ltd get confirmation from the Insured Persons motorcycle insurance company OR the Third Party OR (at Your expense) faxed confirmation from a garage who are a member of the VBRA, MVRA or a similar recognised body, that the Insured Vehicle is a total loss. The Hire Vehicle will not be provided until this information is received f. provision of a Hire Vehicle in Northern Ireland and the Isle of Man is restricted, by law, to drivers aged 23 years and over g. if the Insured Vehicle has suffered theft damage or been stolen You must supply a police crime reference number before a Hire Vehicle can be provided h. the Insured Person may have to provide Comprehensive insurance for the Hire Vehicle We must draw Your attention to the additional terms and conditions of AVR Ltd, which are held by eBike Insurance, and can be viewed on request. They may affect the provision of the Hire Vehicle. What is Not Covered? The following are not covered under this insurance: a. all fuel, fares, fines and fees relating to the Hire Vehicle whilst in your possession b. any claim where the Insured Vehicle was being used for hire or reward c. any claim where Your motorcycle insurers do not provide indemnity under the terms of the underlying motorcycle policy d. any further hire charges incurred after 14 days, or more than 48 hours after payment is issued under the terms of the underlying motorcycle policy for a total loss or theft unrecovered, whichever comes first e. any claim for theft which has not been reported to the Police f. act of God, attempted theft, fire, malicious damage or vandalism g. any claim reported to eBike Insurance more than five days after the Insured Incident h. any claim for a Hire Vehicle more than five days after the Insured Vehicle has been determined a total loss i. sea transit charges in the delivery and collection of the Hire Vehicle j. any claim arising out of a deliberate or criminal act or omission, which is found to the Providers satisfaction to be of a fraudulent or false nature. The Insured Person will be held responsible for any costs paid or incurred as a result k. any excess payable in the event of a claim involving the Hire Vehicle l. any Insured Incident, which took place prior to the commencement of this Policy Notice to the Policyholder/Insured Person Subrogated Rights - The Insured Person must take all reasonable steps to mitigate the costs of the claim - The Insured Person must pay to the Underwriters any sums by way of costs, charges or fees directly recovered from the Third Party to the extent of the sums indemnified under this Policy - The Insured Person must take all action possible to recover any costs, charges or fees the Underwriters may have paid or be liable to pay and pay any such amounts recovered to the Underwriters. - Upon conclusion of the hire of a replacement motorcycle the Underwriters can take over and if necessary conduct proceedings in the name of the Insured Person to recover the hire costs of the Hire Vehicle from the Third Party This insurance shall be subject to English Law, unless specifically agreed to the contrary. All communication is to be conducted in English. Cancellation Right You may cancel Your Policy within 14 days of receipt of the Policy document and receive a full refund, subject to no claim being made upon the Policy. After this 14-day period, You can cancel the Policy at any time, subject to no claim having been made, by contacting eBike Insurance. No refunds will be given. If you do not exercise Your rights to cancel the Policy, it will continue in force for the term of the Policy and You will be required to pay the Premium. Section 1. Loss of or damage to your motorcycle 1.3 New motorcycle replacement We will replace Your Motorcycle with a new Motorcycle of the same make and specification (subject to availability) if, within 6 months of purchase new by you: · Any repair cost or damage covered by the policy exceeds 70% of the list price (including VAT) at the time of purchase; or · Your Motorcycle is stolen and not recovered. Replacement is subject to: · Your Motorcycle being owned by you or having been purchased under a hire purchase agreement (any motorcycle the subject of any type of leasing or contract hire agreement is not eligible for replacement) · The agreement of any interested hire purchase company · You being the first registered owner of Your Motorcycle . | |||
General Exclusions to Part A These General Exclusions apply to all sections within Part A of this policy and describe the things which are not covered. These apply as well as the exclusions shown in each Section of Part A detailing the cover provided. Your policy does not cover the following: (1) Any accident, injury, loss or damage whilst any Motorcycle insured under this policy is being: - Used or ridden otherwise than in accordance with the appropriate sections of the effective Certificate of Motor Insurance. - ridden by or in the charge of anyone who is not described in the Certificate of Insurance as a person entitled to ride or who is excluded from riding by any Endorsements or covered by another policy. - Ridden by any person unless such person holds a licence to ride such Motorcycle and is not disqualified from riding, holding or obtaining such a licence. - Ridden by, or is in the charge of for the purpose of being ridden by any person to whom Your Motorcycle has been hired. - Used in an unsafe or unroadworthy condition or, where such regulations require, does not have a current M.O.T. certificate ( You may be asked to provide details to show that Your Motorcycle was regularly maintained and kept in a good condition.) - used to tow for reward any Trailer or vehicle (or to any property in the Trailer or vehicle) - used to carry passengers or goods in a way likely to affect the safe driving and control of the vehicle (2) Any liability You have accepted under an agreement or contract unless you would have had that liability anyway. (3) The policy does not cover any loss or damage to property, legal liability, expense, consequential loss or bodily injury which is directly or indirectly caused by, contributed to or arising from: (i) ionising radiations or contamination by radioactivity from any irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. (ii) The radioactive, toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component of it. (4) Except as required under the Road Traffic Acts, this Policy does not cover any loss or damage caused by war, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power (5) Any accident, injury, loss or damage (except under Section 2) arising during or in consequence of: (a) earthquake (b) riot or civil commotion occurring elsewhere than in Great Britain, the Isle of Man or the Channel Islands. (6) This policy does not cover racing of any description or being used in any contest, competition, track days, rallies or trials (other than road safety rallies or treasure hunts) or on any other form of racetrack or off-road activity (including green laning). (7) This Policy does not provide cover for any liability, which it is reasonable to conclude, arises out of any acts of terrorism as defined in Part 1 of the UK Terrorism Act 2000 or successors thereto, except as is necessary to meet the requirements of the Road Traffic Acts. In territories other than the United Kingdom the definition contained in the UK Terrorism Act 2000 or its successors will be deemed to be the applicable definition. (8) We will not pay the claim and all cover under the Policy is forfeited if You or anyone acting for You makes a claim under the Policy knowing the claim to be false, fraudulently inflated or supported by fraudulent documents or if the loss, damage or injury is caused by Your willful act or with Your connivance. (9) This Policy does not apply when any motorcycle covered by it is towing more than one Trailer or disabled mechanically propelled vehicle at any one time. (10) Loss or damage directly occasioned by pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speed. (11) This policy does not provide cover for any accident, injury, damage, loss, consequential loss or any liability of whatsoever nature while Your Motorcycle is in or on that part of an aerodrome, airport, airfield or military base provided for: (a) the take off or landing of aircraft and/or the movement of aircraft on the surface (b) aircraft parking aprons including the associated service roads refueling areas and ground equipment parking areas (12) This Policy does not cover death of or bodily injury to any person or damage to any property which is directly or indirectly caused by pollution or contamination, unless this pollution or contamination is directly caused by an incident which occurs in its entirety at a specific time and place during the Period of Insurance and is sudden, identifiable, unintended and unexpected. 2.3 Indemnity to legal personal representatives In the event of the death of anyone insured under this section, We will protect his/her legal personal representatives against any liability of the deceased persons, if that liability is insured under this section. 2.4 Legal Costs If we give Our prior written agreement, We will pay the fees of the legal representatives we instruct to: (a) represent anyone insured under this Policy at any Coroners Inquest or Fatal Accident Inquiry and to defend proceeding in a Court of Summary Jurisdiction for any accident which might give rise to a claim under part (b) below; (b) defend anyone insured under this Policy if legal proceedings are taken against that person for manslaughter or causing death by reckless driving. This cover for legal fees and expenses only applies if: - You ask Us to provide the cover and We agree to provide it; and - the death or deaths giving rise to the proceedings are caused by an incident covered by this policy. 2.5 Exceptions to Section 2 The cover under this section will not apply: (1) If any person insured under this section fails to observe the terms, exceptions and conditions of this policy as far as they can apply. The cover will also not apply if they can claim under another policy. (2) To death or injury to any employee of the person insured which arises out of or in the course of such employment except where such liability is required to be covered by the Road Traffic Acts. (3) To loss of or damage to property belonging to or in the care of anyone we insure who claims under this section, and to property being conveyed by Your Motorcycle . (4) In respect of damage to any Motorcycle in connection with which indemnity is provided by this section. This is provided as standard and covered under the standard Breakdown Assistance Cover provided by Southern Rock Insurance Company Limited 3. Getting You to Your Destination If Your Vehicle cannot be repaired on the same day as the Breakdown, We will either: (a) Pay the cost of transporting Your Vehicle or Insured Person(s) or both to a destination within the Territorial Limit provided that the Insured Person(s) are transported to the same destination; or (b) Arrange transport for Insured Person(s) to travel to a hotel. The most We will pay for transport to the hotel and the cost of hotel accommodation is £300 for any one Breakdown. Section 1. Loss of or damage to your motorcycle 1.1 Loss of or damage to your motorcycle If Your Motorcycle is lost, stolen or damaged, We will, at our option, either - Pay for Your Motorcycle to be repaired; or - Replace Your Motorcycle; or - Pay in cash the amount of the loss or damage. The same cover also applies to Accessories and spare parts relating to Your Motorcycle while these are on Your Motorcycle. The maximum amount We will pay will be the Market Value of Your Motorcycle but not exceeding your estimate of value shown in our records. If, to our knowledge, Your Motorcycle is subject to a hire purchase or leasing agreement, any payment will be made to the owner described in that agreement whose receipt will be a full and final discharge to Us . If a replacement for any damaged accessory or part of Your Motorcycle is not available We will pay the value of the accessory or part at the time of the loss. We will not pay more than the manufacturers last quoted list price in the United Kingdom for the accessory or part. If such list is not available the most We will pay is the manufacturers last quoted list price in the United Kingdom for an equivalent accessory or part. We may use Accessories or parts, which are not made or supplied by the manufacturer of Your Motorcycle but are of a similar type and quality to the parts we are replacing. We reserve the right to replace any parts with a part that is standard to the manufacture of the Motorcycle. We will not be responsible for additional storage costs caused by the unavailability of an accessory or spare part nor the cost of importation of any accessory or part into the United Kingdom. We will retain at Our discretion, the right to the salvage of a vehicle following a total loss for disposal in accordance with the Association of British Insurers code of practice. | |||
Part B - Your Breakdown Assistance Policy Breakdown Definition of terms (a) Mechanical or electrical failure; or (b) Accidental damage, or damage caused by vandalism, Fire, Theft or attempted Theft, which renders Your vehicle immobile. Assistance Services Under This Policy 1. Emergency Roadside Repairs and Home Breakdown We will pay the call-out charge and up to one hours labour costs for one of Our approved agents to attend the scene of the Breakdown and where possible carry out emergency repairs. 2. Vehicle Recovery If Your Vehicle cannot be repaired at the scene of the Breakdown within one hour, We will pay for the cost of transporting Your Vehicle and Insured Person(s) to a single destination, being either; (a) A suitable repairer; or (b) If the Insured Person wishes, their home address provided it is nearer. 3. Getting You to Your Destination If Your Vehicle cannot be repaired on the same day as the Breakdown, We will either: (a) Pay the cost of transporting Your Vehicle or Insured Person(s) or both to a destination within the Territorial Limit provided that the Insured Person(s) are transported to the same destination; or (b) Arrange transport for Insured Person(s) to travel to a hotel. You will have to pay for the cost of this, and the hotel costs; but We will reimburse You up to £50 per person per night for accommodation. We will also pay any expenses for which you have Our written authority to claim. 2.2 Liability Of Others Persons Riding or Using Your Motorcycle On the same basis that we insure You under this section, We will also insure the following persons: - Any person You give permission to ride Your Motorcycle provided that Your Certificate of Motor Insurance allows that person to ride - Any person You give permission to use (but not ride) Your Motorcycle provided that your Certificate of Motor Insurance allows such use. - Any passenger on Your Motorcycle, travelling or getting into or out of your sidecar. This cover is available at a premium of £15.00. Terms and Conditions Membership Your Keycare membership is administered by Keycare Limited, Westgate, Baildon, Shipley, West Yorkshire, BD17 5EJ. The insurance is provided by AIG Europe (UK) Limited and is underwritten by Landmark Insurance Company Limited Conditions Conditions of cover following loss or theft of all keys from the fob holder whilst the keys are attached to the key fob at the time of loss or theft. 1. A one-year period will run from the inception of the membership and then from the anniversary of the inception of the membership. Claims will be accepted, subject to these terms and conditions, for: locksmiths charges; new locks and keys; the cost of opening safes; and reasonable transportation costs following the theft or loss of keys. You can also claim for the cost of replacing lost or stolen handsets for vehicle immobilisers and/or alarms up to a maximum of one per vehicle. The cost of reprogramming immobilisers and alarms as a result of loss or theft of handsets. The maximum amount you can claim in any one year is £1,000 per registered key fob. 2. Cover is for the period stipulated on your membership and then for any subsequent period for which we accept your renewal premium. Keyfob 3. All keys, which are attached to your Keycare fob, are covered, subject to your Keycare membership being in force at the time of loss and the key fob being registered with Keycare Limited. 4. A key fob issued by Keycare Limited must be attached to the lost or stolen keys or handsets at the time of loss or theft. 5. The key fob must have been lost or stolen from the fob holder or a member of the fob holders immediate family residing at the fob holders address (or where the fob holder is a Company, by an authorised employee of the fob holder). 6. Key fobs must not be used when cover has ceased. Claims 7. You must give Keycare Limited immediate notice of any loss or theft of keys. 8. Where keys are stolen and you have notified Keycare Limited, subject to these terms and conditions, you will be given permission to claim immediately. 9 Where you use an approved Keycare Limited locksmith. Where your keys are locked in a property or vehicle or broken in a lock, locksmith charges will be paid within the £1,000 annual limit per registered key fob. 9a Where you have opted to use your own locksmith and not an approved Keycare Limited locksmith. Your membership will operate on a pay and claim basis. You will be required to make all initial payments for work carried out and reasonable transportation costs within the £1,000 annual limit per registered key fob. Where your keys are locked in a property or vehicle or broken in a lock, locksmith charges will be paid within the £1,000 annual limit per registered key fob. 10. No keys shall be deemed to be irrecoverably lost until 3 days after the loss is reported to Keycare. After that time a claim can be made. 11. In the case of lost keys, but not in the case if keys have been stolen, you will only be reimbursed for new locks: a) if it would be possible for someone who found the lost keys to trace those keys to your vehicle or premises: or b) if the lost keys were the only keys you had, that is, you can not obtain replacements from the duplicate keys or from the number of the keys to which the lost keys relate 12. Receipts must be retained for new keys and new locks, locksmiths charges, bike hire and transportation costs. Such receipts should be made available at the request of Keycare Limited. 13. Replacement items shall be to no higher standard than the items, which are replaced. 14. The maximum number of keys, which can be claimed for, is 3 keys per lock. 15. Keycare protection applies within the European Union although assistance may not always be available. 17. A reward of £10 will be sent directly by Keycare Limited to the person who found your keys, and you will not be asked to contribute. Bike Hire 18. Any alternative bike hire can only be authorised by Keycare Limited. 19. Public transportation costs and taxi fares can be claimed in lieu of bike hire. You must ensure that the cost is reasonable and justified. 20. Bike hire and transportation facilities are only available to get you to your home or other intended destination, retrieve spare keys, or when your bike is garaged awaiting new locks to be fitted. 21. The maximum period of bike hire is 3 days commencing immediately upon the loss or theft. 22. The hired bike will not exceed 600 cc and the hire period commences immediately upon the loss or theft of keys of the fob holders bike. 23. Evidence of ownership of the bike or premises to which the stolen or lost keys relate may be required. Fraud All benefits under your Keycare membership are forfeited if you make a fraudulent claim. Details of false or fraudulent claims will be passed to the Police. Notice of Cooling Off Period You have the right to cancel your Keycare membership if you decide that this is no longer appropriate for you. If you decide within 14 days of the date noted on your membership letter that you do not want it, please call us direct on 0845 303 4013. Providing that no claim has been made in the meantime, we will cancel your membership straight away and refund any premium that you may have paid. Contribution Clause We will not seek a contribution from any other party such as your Household Insurance Policy or your Motor Insurance Policy. Governing Law You and we can change the law, which applies to this contract. In contacting you we may also provide you with details of other promotions or services that we feel may be of specific interest to you. Definition of terms Accessories Additional or supplementary parts of your motorcycle not directly related to its function as a motorcycle. These include radios that form an integral part of the motorcycle , top boxes, tank bags and other luggage carriers while fitted to your motorcycle. 1.1 Loss of or Damage to Your Motorcycle If Your Motorcycle is lost, stolen or damaged, We will, at our option, either: - Pay for Your Motorcycle to be repaired; or - Replace Your Motorcycle; or - Pay in cash the amount of the loss or damage. The same cover also applies to Accessories and spare parts relating to Your Motorcycle while these are on Your Motorcycle. The maximum amount We will pay will be the Market Value of Your Motorcycle but not exceeding your estimate of value shown in our records. If, to our knowledge, Your Motorcycle is subject to a hire purchase or leasing agreement, any payment will be made to the owner described in that agreement whose receipt will be a full and final discharge to Us . If a replacement for any damaged accessory or part of Your Motorcycle is not available We will pay the value of the accessory or part at the time of the loss. We will not pay more than the manufacturers last quoted list price in the United Kingdom for the accessory or part. If such list is not available the most We will pay is the manufacturers last quoted list price in the United Kingdom for an equivalent accessory or part. We may use Accessories or parts, which are not made or supplied by the manufacturer of Your Motorcycle but are of a similar type and quality to the parts we are replacing. We reserve the right to replace any parts with a part that is standard to the manufacture of the Motorcycle. We will not be responsible for additional storage costs caused by the unavailability of an accessory or spare part nor the cost of importation of any accessory or part into the United Kingdom. We will retain at Our discretion, the right to the salvage of a vehicle following a total loss for disposal in accordance with the Association of British Insurers code of practice. Exclusions to Part A Section 1 of Your Policy Your Policy does not cover the following: (a) Loss of use, depreciation, wear and tear. (d) Loss of or damage to Accessories and spare parts by Theft if Your Motorcycle is not stolen at the same time. (f) Loss or damage arising from Theft whilst the ignition keys of Your Motorcycle have been left in or on Your Motorcycle (i) Loss or damage to helmets, gloves, leathers, boots and any other protective clothing or personal belongings. (j) Loss or damage arising whilst Your Motorcycle is being riden by or in the charge of any person who is under the influence of alcohol or drugs; or has a blood or urine alcohol content in excess of the legal limit or; refuses to supply a breath, blood or urine sample. (u) Any amount above the cost (or in the case of a vehicle of foreign manufacture the sterling equivalent of the cost) of any parts or Accessories according to the manufacturers last published list price plus the reasonable cost of fitting. | |||

5.3 International Motor Insurance Card (Green Card) All countries mentioned in 5.1 have agreed that a Green Card is no longer necessary for cross border travel. Your policy, Schedule and Certificate of Motor Insurance will therefore provide sufficient evidence that you are complying with the laws relating to compulsory motor insurance in any of these countries that you visit. There is no cover for countries outside the Territorial Limits. | |||
3. Getting You to Your Destination If Your Vehicle cannot be repaired on the same day as the Breakdown, We will either: (a) Pay the cost of transporting Your Vehicle or Insured Person(s) or both to a destination within the Territorial Limit provided that the Insured Person(s) are transported to the same destination; or (b) Arrange transport for Insured Person(s) to travel to a hotel. You will have to pay for the cost of this, and the hotel costs; but We will reimburse You up to £50 per person per night for accommodation. The most We will pay for transport to the hotel and the cost of hotel accommodation is £300 for any one Breakdown. You must pay the hotel bill, but We will pay You back on receipt of the relevant bill(s) subject to the £300 limit for any one Breakdown. General Conditions The following General Conditions apply to all of this Policy. These describe Your responsibilities, general information and the procedures that apply in certain situations, such as when there is a claim or the Policy is cancelled. If You do not meet the terms and conditions of this Policy, it could make the cover invalid or mean We may refuse to pay Your claim Claims procedure - As soon as reasonably possible after any accident, injury, loss or damage You must report to Us all details of the incident. If you are calling from outside the UK please contact our European Claims First Response team on 00 44 1454 636964. - You should immediately send Us any communication You receive about the incident. - You must immediately let Us know if anyone insured under this policy is to be prosecuted as a result of the incident, or if there is to be an inquest following a fatal accident. - You, or anyone else claiming under this policy, must not admit to any claim, promise any payment or refuse any claim without Our written consent. - We can take over, if We so wish, and conduct in Your name or the name of the person claiming under the policy the defence or settlement of any claim or take proceedings for Our own benefit to recover any payment We have made under this policy. We shall have full discretion in the conduct of any proceedings or the settlement of any claim. The person who is seeking payment under this policy shall give Us all the assistance necessary in order for Us to achieve settlement. - In the event of a claim covered by this Policy you must still pay the premium. Your duty to comply with policy conditions Your premium is based on the information You gave Us when Your cover started and when You renew it. If Your circumstances change You must tell eBike Insurance. Please notify eBike Insurance of any changes being made to the policy on www.ebikeinsurance.co.uk. You should keep a record of the information You give in relation to this Policy. If you did not or do not give full and accurate information or you fail to notify us of any changes in circumstances, this policy may be rendered invalid and We may refuse to deal with any claim You might make. This insurance will only apply if: - the person claiming has kept to all the terms and conditions of this Policy; and - all the information You have given and upon which the Policy is based is correct and complete. Fraud If any claim is in any way fraudulent or if You or anyone acting on Your behalf has used any fraudulent means, including inflating or exaggerating the claim or submitting forged or falsified documents, all benefits under this policy shall be forfeited. Monthly Premiums If the premiums are paid monthly and You fail to pay an instalment when due or fail to maintain a Direct Debit Mandate and such default is not corrected within the time permitted by the Consumer Credit Act 1974 the whole of the outstanding balance will become due and payable. If this sum is not paid within seven days the insurance cover will be cancelled. In the event of a total loss claim under this policy, all remaining monthly premiums for the period of the insurance contract will immediately become due. Endorsements which may apply E3 Garaging Excess If you do not keep Your Motorcycle in a locked private garage between 22.00 and 06.00 (BST or GMT as applicable) when the motorcycle is parked at or in the proximity of your private dwelling, you are responsible for the first £250 of each claim under Section One for loss of or damage to Your Motorcycle, irrespective of the time of loss.
